FAMILY LAW / DIVORCE

Uncontested Divorce

There is often confusion about the difference between an uncontested divorce and a contested divorce. Generally speaking, an uncontested divorce is usually based upon irreconcilable differences and the parties have reached an overall consensus on how their estate should be separated and how to handle custody, visitation, child support, and alimony issues, if they are applicable.

Our firm is qualified to assist you in preparing a comprehensive settlement agreement. We can assist by streamlining the process and helping move it through the courts as efficiently as possible. In situations where the parties feel they may be able to resolve their differences without protracted litigation, we have involved mediators early in the divorce process so the couple can develop a comprehensive written agreement before either party files for divorce.

Contested Divorce

When one or more of the above factors cannot be agreed upon, it becomes a contested divorce. Donald Huskins has handled both contested and uncontested divorce cases for the past 30 years. Mr. Huskins is considered by many as one of the best divorce attorneys in middle Georgia and the state. Often involving litigation, contested divorce cases can and are usually very stressful and time consuming. Depending on our current case load we will accept contested divorce cases on a case by case basis.

Probate of Last Will and Testament - This proceeding, although for the most part administrative, can be difficult and time consuming for grieving family members. We will use our expertise and experience to make this process as fast and pain free as possible. We have also successfully litigated contested will cases in the Probate Court and continue to do so when the need arises.

Administration - This proceeding is used to handle an estate of a deceased who did not have a Last Will and Testament.

Guardianships/Conservatorships - When an individual can no longer legally speak for themselves or is incompetent to manage their affairs because of their health condition, this proceeding is used to legally name an individual to make all decisions.

Petitions for Year’s Support – A surviving spouse and minor children are entitled under Georgia law to a year’s support based on year prior to the decedant’s death. We have Petitioned and litigated both sides successfully regarding year’s support petitions and caveats.

PERSONAL INJURY/AUTO ACCIDENT/WRONGFUL DEATH

No injured person should have to deal directly with an insurance company concerned solely with how little they can get out of compensating you. We have successfully represented many clients injured by the negligent acts of another. These cases have included Automobile accidents and Wrongful death claims arising out of the same, Wrongful death claims arising out of boating accidents, personal injury claims suffered on the property or business of another and others.

Business Formation (LLC’s, INC’s)

The all-important first step of establishing a business begins by defining a clear separation of business and personal affairs, and establishing a legal entity, such as a corporation or a limited liability corporation, to protect your own assets from your business’ liabilities.

Contract Drafting

While you may be tempted to use do-it-yourself contract templates found on the Internet and elsewhere, the money you save up front can pale in comparison to the money you spend later on court costs and attorney fees.

Poorly drafted contracts inevitably result in disputes that end up in court. Vagueness in contracts is the number one reason our firm litigates contract cases – each party thinks that some key term means something the other party has not intended. Not only does a badly drafted contract lead to litigation, it will also likely entail increased legal fees. Attorneys will spend time arguing about what the contract actually means and the dispute may still end up in trial to finally resolve differences in interpretation. DUI

Whether it is you 1st, 2nd, or 3rd DUI in the last five years, your drivers license is in jeopardy, not to mention the other “mandatory minimum” sentences a conviction would carry. Were you also issued a Form 1205 Administrative Suspension? DUI’s, while misdemeanors in most circumstances, have become one of the more complex criminal cases to resolve. Each year the legislature seems to make the penalties more severe, especially for underage drivers.
